Historic School Rehabilitation Tax Credit Proposed in House and Senate

School modernization and rehabilitation was on lawmakers’ minds this week as the Senate leadership announced its intentions this week to move elements of the President’s jobs act proposal – including a school modernization package -- in that chamber while the House leadership identified 12 areas of possible “areas of commonality” on its own jobs proposal that the House would consider after it returns from a week-long recess on October 24th.  

In addition, Virginia Senators Jim Webb and Mark Warner jointly introduced a bill – The Rehabilitation of Historic Schools Act of 2011 (S. 1685) —that would allow the federal rehabilitation tax credit to be used for rehabilitation of historic schools.  

The Webb-Warner bill is perhaps an acknowledgment about the difficult of accessing federal funding for school modernization under Title I of the Elementary and Secondary Education Act (ESEA), which is distributed to state educational agencies by formula and doesn’t include a separate set-aside for historic schools.  

For the time being, the National Trust is examining the Webb-Warner bill for its implications in the larger context of improving and expanding the use of the federal rehabilitation tax credit.
