Bill to Amend the Antiquities Act of 1906 Introduced

Rep. Devin Nunes (R-CA) introduced a bill (HR 5580) this week that would amend the Antiquities Act of 1906 and require Congress (within two years) to approve any presidential proclamations of national monuments.  The bill would require the President to provide notice and the actual language of the proposed designation to Congress, Governors, local governments, and tribes within the boundaries of the proposed monument; provide notice of public hearings and allow opportunity for public comments; and, report to Congress on how the designation would impact local tax revenues, national energy security, land interests, rights, and uses.  Rep. Nunes claims that his bill -- the Antiquities Act Designation Transparency Act of 2010 -- preserves the president's "right to protect national treasures that are under threat, but it ensures his or her actions are confirmed by Congress."  The Nunes bill comes on a wave of other individual lawmakers who have introduced similar bills that would be applicable to their individual states.  The National Trust has opposed amending the Antiquities Act dating back to several Congresses and is closely monitoring the Nunes bill, which may be included in a public lands omnibus bill that could be considered later this summer.
