Advisory Council on Historic Preservation Establishes Timeline for Section 106 Review at Summer Board Meeting
Last week the Advisory Council on Historic Preservation(ACHP) held their summer board meeting. The primary regulatory issue on the agenda was the previously discussed review of the 800 regulations that form the backbone of how Section 106 of the National Historic Preservation Act (NHPA) is implemented. During the meeting, Council members considered and approved a motion directing ACHP staff to develop a schedule with milestones and deliverables for revising the Section 106 implementing regulations within 30 days and and give Councill members 60 days to “provide substantive feedback and proposed changes to current regulations.” Importantly, the motion does not direct any changes to the regulations or set a specific deadline on when the Council would vote on changes. This action follows the announcement at the Council's February meeting that the ACHP would consider changes to the Section 106 regulations.
During the meeting, the National Association of Tribal Historic Preservation Officers offered a motion seeking for the ACHP to commit to broad and meaningful coordination with Indian Tribes to inform the Section 106 review process, citing the early coordination with Tribes was critical. Ultimately that motion did not pass, but ACHP Vice Chair, Travis Voyles, pledged to engage meaningfully with Tribes in the review process.
Also during the meeting, the ACHP provided updates on Council actions, updates on recently approved program alternatives, and on legislative priorities and the ACHP's role in advising Congress and the Administration on historic preservation matters.
